Throughout these Terms, “we”, “us” and “our” refer to Alera Mode / AVINEX COMMERCE.
“You” refers to the customer placing an order via the Website.

By placing an order, you agree to be bound by these Terms. We recommend that you read them carefully before purchasing.

2. Eligibility

To place an order on this Website, you must:

  • Be at least 18 years old; or

  • Have permission from a parent or legal guardian.

By placing an order, you confirm that you meet these requirements.

3. Changes to These Terms

We reserve the right to amend these Terms at any time.

The latest version will always be available on our Website.
Where changes are material, we will take reasonable steps to inform customers in advance.

4. Orders and Contract Formation

All orders placed via the Website are subject to acceptance.

A legally binding contract is formed when you receive an order confirmation email from us.

We reserve the right to:

  • Refuse or cancel an order where a product is out of stock;

  • Cancel orders where there is an obvious pricing or product description error;

  • Refuse orders where fraud or unauthorised activity is suspected.

If payment has already been taken for a cancelled order, a full refund will be issued.

5. Prices and Payment

5.1 Pricing

All prices are displayed in GBP (£) for UK customers and include VAT where applicable.

Delivery costs (if any) are clearly displayed before checkout.

We reserve the right to change prices at any time, but changes will not affect confirmed orders.

5.2 Payment

We offer secure payment methods through trusted third-party payment providers.

Available payment options are displayed at checkout.

We reserve the right to:

  • Restrict certain payment methods;

  • Decline transactions suspected of fraud or misuse.

Payment must be received in full before goods are dispatched.

6. Delivery

6.1 Dropshipping Model

We operate a dropshipping model, meaning some products are shipped directly from our suppliers.

As a result:

  • Delivery times may vary;

  • Orders may arrive in separate shipments.

Although products may be shipped by third-party suppliers, we remain fully responsible as the retailer under UK consumer law.

6.2 Delivery Area

We deliver to customers within the United Kingdom.

Delivery time estimates are provided for guidance only and are not guaranteed.

Tracking details will be sent by email once your order has been dispatched.

6.3 Free Delivery

We offer free standard delivery on all orders unless otherwise stated.

6.4 Delays

If we become aware of a significant delay, we will inform you as soon as reasonably possible.

If delivery is substantially delayed and we are at fault, you may have the right to cancel and receive a refund in accordance with the Consumer Rights Act 2015.

6.5 Transfer of Risk

Risk in the goods passes to you when the goods are delivered to:

  • You; or

  • A person identified by you to take possession of the goods.

7. Right to Cancel (Consumer Contracts Regulations 2013)

If you are a UK consumer, you have the right to cancel your order within 30 days of receiving the goods.

You are responsible for return postage costs unless the goods are faulty or incorrect.

Returned goods must be:

  • In substantially the same condition as received;

  • With original packaging and labels where possible.

Refunds are processed within 5 business days of receiving and approving the returned goods. We may withhold reimbursement until goods are received or proof of return is provided.

The right to cancel does not apply to:

  • Personalised or custom-made goods;

  • Sealed goods unsuitable for return for hygiene reasons once unsealed (e.g. underwear).

Your statutory rights remain unaffected.

8. Faulty Goods and Legal Rights
(Consumer Rights Act 2015)

If goods are faulty, damaged or not as described, you are entitled to remedies under the Consumer Rights Act 2015.

This includes:

  • The right to reject goods within 30 days for a full refund;

  • The right to request repair or replacement;

  • The right to a price reduction or final right to reject if repair or replacement is unsuccessful.

Nothing in these Terms limits your statutory rights.

9. 12-Month Commercial Guarantee

In addition to your statutory rights, Alera Mode offers a 12-month commercial guarantee on clothing items.

This covers manufacturing defects present at the time of delivery, including:

  • Loose stitching

  • Faulty zips

  • Detached buttons

  • Significant production defects

The guarantee does not cover:

  • Normal wear and tear

  • Damage caused by improper washing or misuse

  • Accidental damage

This guarantee is provided in addition to your legal rights and does not replace them.

10. Returns and Refunds

This policy forms part of these Terms.

11. Limitation of Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:

  • Death or personal injury caused by negligence;

  • Fraud or fraudulent misrepresentation;

  • Breach of statutory consumer rights.

Subject to the above:

  • We are not liable for indirect or consequential losses (including loss of profit or business interruption).

  • Our total liability shall not exceed the purchase price of the goods concerned.

12. Force Majeure

We shall not be liable for failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters

  • Pandemics

  • Strikes

  • Supply chain disruption

  • Technical failures

Where such events occur, we will take reasonable steps to minimise disruption.
